Expedited Process (SB92-202)

Description:

The Colorado Legislature established an expedited review process for projects meeting certain criteria.  This process accelerates qualifying projects during the Legislative portion of the approval process.  This process is sometimes called "the 202 Process" or a project may be called a "202 project" meaning that it is eligible for expedited review.

The criteria for qualifying fo the expedited process are:

  • the project must be constructed, operated and maintained from qualifying funds;
  • the funds used come solely from auxiliary enterprises, student fees, research building revolving funds, or wholly endowed gifts and bequests or a combination of such sources.
Notes:

1)  Program plans are still required for projects over $1,000,000. 

2)  The project request must still go before CCHE, CDC and the JBC.  The JBC must act on a project withing 30 days of CDC action if in session or 60 days if out of session.  There are no restrictions on action by CCHE, but generally this occurs within 60 days of action by the Board of Regents.  Thus, Legislative approval occurs between 90 and 120 days after Board of Regents approval.

3)  ICR monies are not generally qualifying unless paid as rent to the Research Building System.
