Six-Month Rule

Description:

CRS 24-30-1404-(7) requires State agencies to execute a contract and encumber funds for any professional services related to a capital construction or controlled maintenance project within six months of the date the appropriation becomes law.  For projects when no  professional services contract is required, a contract for the projet must be entered into  within the same six month period.

Notes:

1)  The six-month rule only applies to projects that receive a portion of their funds as State Capital Construction Funds -- Exempt

2)  In most cases, encumbering the funds through the architectural or engineering contract is sufficient to meet the obligations of the statute.

3)  Waivers or extensions are possible but are not desireable.
